1. Introduction

Welcome to Folio Labs ("Folio Labs", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of our website and AI-powered architectural rendering services (collectively, the "Service") located at foliolabs.design.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Platform Description

Folio Labs is an independent product and interface layer for AI-powered architectural rendering. Our Service transforms model screenshots from SketchUp, Rhino, Revit, and other design tools into polished AI renders while preserving the original building form, massing, and camera viewpoint.

Image generation on Folio Labs is powered by third-party AI models, including Nano Banana and GPT Image 2. Folio Labs is an independent interface layer and is not affiliated with or endorsed by the underlying model providers unless explicitly stated otherwise.

3. User Accounts

To access certain features of our Service, you may be required to create an account. When creating an account, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information to keep it accurate
• Be at least 18 years old or the age of legal consent in your jurisdiction

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Intellectual Property and Content Rights

Your Content

You retain ownership of the model screenshots, reference images, prompts, and other content you upload or submit to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process Your Content solely for the purpose of operating and providing the Service to you.

Generated Outputs

Subject to these Terms and applicable law, paid subscribers may use AI-generated render outputs for personal or commercial purposes. Free users may use generated outputs for personal and non-commercial evaluation purposes only, unless Folio Labs expressly states otherwise.

You are responsible for ensuring that your prompts, uploads, and resulting outputs do not infringe third-party rights, violate applicable law, or breach these Terms. AI-generated renders are creative interpretations and do not constitute engineering drawings, construction documents, or professional architectural certification.

Our Service

The Service, its original content, features, and functionality are and will remain the exclusive property of Folio Labs and its licensors. Our trademarks and trade dress may not be used without our prior written consent.

5. Acceptable Use and Prohibited Content

You agree not to use the Service to generate or attempt to generate:

• Content that violates any applicable laws or regulations
• Content that infringes on intellectual property rights, including unauthorized reproductions of copyrighted architectural designs
• NSFW, sexually explicit, nude, or pornographic content
• Hateful, discriminatory, or offensive content
• Content intended to harass, abuse, exploit, or harm others
• Violent, deceptive, fraudulent, or otherwise harmful content
• Content that impersonates another person or misrepresents your affiliation

We may block, remove, refuse to process, or restrict access to content or accounts that violate these Terms or create legal, safety, or abuse risks.

6. Subscriptions, Credits, and Billing

If you purchase a subscription, credits, or other paid features, the applicable pricing, billing terms, and product entitlements will be presented at checkout or on the pricing page. All payments are:

• Processed through secure third-party payment providers
• Subject to the payment provider's terms and conditions
• Charged in accordance with your selected plan (monthly or annual)

Users can manage or cancel their subscription from the pricing page or account settings. Cancellation stops future renewals but does not retroactively cancel benefits already provided for the current billing period, unless required by law.

7. Refunds

As a general rule, digital products and AI generation credits are non-refundable once consumed. If you have a refund request or billing issue, please contact support@foliolabs.design. We review refund-related requests on a case-by-case basis and will generally respond within 3 business days. For more details, see our Refund Policy.

8. Third-Party AI Providers

Our Service relies on third-party AI model providers for image generation. We do not guarantee the availability, accuracy, or output quality of any third-party model. Folio Labs is not responsible for:

• Downtime or service interruptions from third-party providers
• Changes to third-party model capabilities or output characteristics
• Content policies enforced by third-party providers that may affect your generations

In the event of a provider-side generation failure after credits have been deducted, Folio Labs will refund the corresponding credits to your account.

9. Important Disclaimer — Not Engineering Documents

AI-generated renders produced by Folio Labs are creative visual studies intended for conceptual exploration, client presentations, and design communication. They are NOT:

• Engineering drawings or construction documents
• Structurally or dimensionally accurate representations
• Substitutes for professional architectural, engineering, or construction review
• Certified or stamped by a licensed professional

Always verify critical design decisions with qualified professionals and use production rendering and documentation tools for final deliverables.

10. DMCA and Copyright Complaints

We respect the intellectual property rights of others. If you believe that content hosted on or generated through our Service infringes your copyright, please send a notice to support@foliolabs.design with:

• A description of the copyrighted work you claim has been infringed
• A description of where the allegedly infringing content is located
• Your contact information (email, address, phone)
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate

11. Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. Generated assets are retained for 30 days; please download important results promptly.

12. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL FOLIO LABS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page. Continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in London, United Kingdom.
